Termination of a Participating Pharmacy Agreement

Under the provisions of the HMSA Participating Pharmacy Agreement, either the pharmacy or HMSA may terminate the contract with appropriate written notification. Please refer to the appropriate termination section within your contract.

As of the date of expiration or termination of the Agreement, the Agreement is considered terminated with the exception of the following:

• HMSA will pay the Participating Pharmacy for covered services provided to members prior to termination based on date of service.
• Any provisions of the Agreement that are intended to survive, do survive the expiration or termination of the Agreement.

The parties shall reasonably cooperate to resolve any outstanding matters related to the Agreement.

HMSA or its designee shall have access to the Participating Pharmacy's records for six (6) years from the date of services covered, including the right to inspect, audit and reproduce records and materials to verify claims and reports.
